Former Survivor: Gabon contestant Dan Kay died ‘unexpectedly’ on New Year’s Eve at the age of 40.

The New Hampshire attorney’s death is not currently being investigated by the Brookline police for foul play.

Dan is survived by his two children – Reese Elizabeth Kay and Jackson ‘Jax’ Russell-Reid Kay – as well as his girlfriend Jennifer DePietro.

The lawyer was ‘known for his hard work, dedication, attention to detail and strong work ethic’, according to his obituary.

The obituary described his love of running, skiing and listening to music.

‘Dan had a smile that could light up a room. His desire to be challenged and his quest for adventure lead to his participation on the reality show, ‘Survivor’,’ the obituary noted.

Dan was the eighth person voted off the dismally-reviewed 17th season of the CBS competition.

The season aired in 2008 and was set in Africa.

On Tuesday, the show’s host Jeff Probst tweeted his condolences for the ‘sudden loss’ and wrote: ‘The Survivor family sends our love to Dan’s family.’

Gabon’s second runner-up Jessica ‘Sugar’ Kiper also wrote on Facebook that her thoughts were with Kay’s family.

The devout Christian – who had a ‘Carpe Diem’ tattoo – held a bachelor’s degree from UMass-Amherst and a law degree from Syracuse University.

Kay’s obituary revealed his funeral service will be held this Saturday at Lambert Funeral Home & Crematory in Manchester.
